ITER is a joint international research and development project that aims to demonstrate the scientific and technical feasibility of fusion power. The partners in the project - the.

ITER Parties - are the European Union (represented by EURATOM), Japan, the People´s Republic of China, India, the Republic of Korea, the Russian Federation and the USA. ITER will be constructed in Europe, at Cadarache in the South of France.

Habilitación para el ejercicio de la actividad profesional:

* The exclusion criteria are listed in Article 83 of the Fusion for Energy Financial Regulation. Tenderers shall be excluded from participation in the present procurement procedure if:

a) They are bankrupt or being wound up, are having their affairs administered by the courts, have entered into an arrangement with creditors, have suspended business activities, are the subject of proceedings concerning those matters, or are in any analogous situation arising from a similar procedure provided for in national legislation or regulations;

b) They have been convicted of an offence concerning their professional conduct by a judgement which has the force of res judicata;

c) They have been guilty of grave professional misconduct proven by any means which the Joint Undertaking can justify;

d) They have not fulfilled obligations relating to the payment of social security contributions or the payment of taxes in accordance with the legal provisions of the country in which they are established or with those of the country of the Joint Undertaking or those of the country where the contract is to be performed;

e) They have been the subject of a judgement which has the force of res judicata for fraud, corruption, involvement in a criminal organisation or any other illegal activity detrimental to the Joint Undertaking's or the Communities financial interests;

f) They are currently subject to an administrative penalty imposed by the Community institutions as referred to in the Financial Regulation applicable to the budget of the European communities.

In accordance with Article 84 of the Fusion for Energy Financial Regulation, a contract shall not be awarded to tenderers who, during the present procurement procedure:

g) Are subject to a conflict of interest

h) Are guilty of misrepresentation in supplying the information required by the Joint Undertaking as a condition of participation in the contract procedure or fail to supply this information.

In their tenders, tenderers shall provide a declaration on their honour, duly signed and dated, stating that they are not in one of the situations listed above.

Only the tenderer to whom the contract is to be awarded shall provide the documents mentioned below before signature of the contract and within the deadline given by Fusion for Energy.

The following documents will be accepted as proof that the tenderer is not in any of the situations mentioned under points a), b), c), d), e), f) above:

i) For a), b) and e), a recent extract from the judicial record or, failing that, an equivalent document recently issued by a judicial or administrative authority in the country of origin, showing that those requirements are met;

ii) In the case mentioned under d), a recent certificate issued by the competent authority of the Member State concerned. Where the document or certificate referred to above is not issued in the country concerned it may be replaced by a sworn statement or, failing that, a solemn statement made by the interested party before a judicial or administrative authority, a notary or a qualified professional body in its country of origin;

iii) In the cases mentioned under c) and f), the tenderer will have to provide a sworn statement or, failing that, a solemn statement made by the interested party before a judicial or administrative authority, a notary or a qualified professional body in its country of origin.

Depending on the national legislation of the country in which the tenderer is established, the documents referred to above shall relate to legal persons and/or natural persons including directors of economic operators or any person with powers of representation, decision-making or control in relation to the tenderer.

Fusion for Energy may waive the obligation of the winning tenderer to submit this evidence if it has already been submitted to Fusion for Energy for the purposes of another procurement procedure and provided that the documents are still valid and that they have not been issued more than one year ago.

In case of of joint tendering/subcontracting, a declaration on honour, duly signed and dates, must be submitted by each individual economic operator in the group / subcontractor, stating that they are not in any of the situations listed above.

* As evidence that the tenderer is authorised to perform the contract under national law, the tenderer shall provide: full name of the economic operator, legal form of the entity, address of the registered office, registration number and date of registration, VAT registration number, contact person (with contact details) responsible for the tender, legal representative of the economic operator, as signatory of the contract.

The information to be provided shall be accompanied by a transcript or a certificate, issued by the competent body, usually the commercial register, in the country of origin or the country of the registered office of the tenderer. Non-commercial undertakings may provide a copy of their act of incorporation, if, under the laws of their country of origin or the country of the registered office, they are not subject to public registry. Natural persons shall provide a copy of their passport or other equivalent identification document.

In case of of joint tendering/subcontracting, the eveidence should be submitted by each individual economic operator in the group/subcontractor.

Situación económica y financiera:

The tenderer shall have the adequate economic and financial capacity to perform the contract. To provide evidence of this, the following documents shall be provided by the tenderer in the tender:

a) A statement of the annual turnover concerning the services covered by the contract during a period which may be no more than the last three financial years.

Minimum criterion to meet: the average annual specific turnover for the last three financial years must be above 2 000 000 EUR.

b) A statement of the overall annual turnover during a period which may be no more than the last three financial years.

Minimum criterion to meet: the average annual turnover for the last three financial years must be above 4 000 000 EUR.

c) Presentation of Balance Sheets and Profit and Loss accounts for at least the last three years for which accounts have been closed, where publication of the balance sheet is required under the company law of the country in which the economic operator is established.

Balance Sheets and Profit and Loss account shall be presented both in the official format of the Tenderer and in the template provided by Fusion for Energy in the Simplified Balance Sheet and Profit & Loss form.

General assessment of the economic and financial viability of the tenderer is carried out on the basis of standard liquidity, financial autonomy, profitability and solvency ratios (average for the last three years for which accounts have been closed).

Economic and financial viability of the tenderer will be pronounced negative if 2 out of the 4 following ratios are considered negative:

— liquidity:

— ratio: (current assets – inventories – debtors > 1 year) / short-term debt (bank and non-bank),

— the evaluation will be considered negative if ratio < 0,5,

— profitability:

— ratio: gross operating profit / turnover,

— the evaluation will be considered negative is ratio < 0,05,

— solvency:

— ratio: total debt / (capital and reserves – 50 % of intangible assets),

— the evaluation will be considered negative if ratio > 6 or < 0,

— financial autonomy,

— ratio: interest / gross operating profit,

— the evaluation will be considered negative if ratio > 0,40 or < 0.

If, for some exceptional reason which the Joint Undertaking considers justified, the tenderer is unable to provide the references requested above, its economic and financial capacity may be proved by any other means which the Joint Undertaking considers appropriate.

An economic operator may, where appropriate, rely on the capacities of other entities, including subcontractors, regardless of the legal nature of the links which it has with them. It must in that case prove to the Joint Undertaking that it will have at its disposal the resources necessary for performance of the contract, for example by producing an undertaking on the part of those entities to place those resources at its disposal. Templates for this purpose are provided in the Subcontractor Acceptance Form and the Parent Company Undertaking Form.

Under the same conditions, a consortium may rely on the capacities of members of the consortium or of other entities, including subcontractors.

Capacidad técnica y profesional:

The technical and professional capacity of economic operators shall be assessed with regard in particular to their know-how, efficiency, experience and reliability. Evidence of the technical and professional capacity of economic operators shall be furnished on the basis of the following:

a) The educational and professional qualifications of the staff and management and, in particular, those of the person or persons responsible for performing the contract (Staff is defined as a current employee of the tenderer or where there is an agreement in place that the person is willing to become an employee of the tenderer to provide the service). The tenderer must give evidence of the full coverage of the professional competences and experience at a level commensurate with the duties described in Technical Specification.

For this purpose, the proposed team shall fulfil the technical profiles described in section 3.1 of the Technical Specification and shall as a minimum include:

— 4 primavera schedulers,

— 3 planning engineers,

— 1 primavera application administrator,

— 1 primavera application developer.

As evidence of the capabilities under point a), the candidate shall submit the detailed education and professional background of the requested technical profiles.

b) The tenderer must provide proof of experience in providing the services as defined in the Technical Specification. Therefore, the tenderer shall provide evidence showing that it has provided within the last five (5) years and in a nuclear, defence, or aeronautics related or other relevant environment, at least:

(i) Three (3) projects with a cumulative value above EUR 600.000 during which the tenderer has provided Primavera P5/P6 Project Management based planning & scheduling support services equivalent to the services described in the Technical Specification.

(ii) One (1) project with a value above EUR 75.000 during which the tenderer has integrated or implemented in an architecture, two or more of the following Primavera modules: Contract Management, Reporting and Analytics.

(iii) One (1) project with a value above EUR 30.000 during which Primavera Risk Analysis was used, implemented or supported.

As evidence for the above, the candidate shall submit a list of projects, involving the provision of planning & scheduling support services, indicating the following information for each of them:

— project/service topic,

— project value/budget,

— duration and delivery dates,

— external customers,

— publicly funded project (european commission’s framework programmes) – (y/n),

— details on use of primavera project management,

— details on use of primavera contract management, reporting, analytics, risk analysis.

Where the services referred to in point (b) of the first subparagraph are provided to the Joint Undertaking, evidence of performance shall be in the form of certificates issued or countersigned by the competent authority.

Where the services to be provided are complex or, exceptionally, are required for a special purpose, evidence of technical and professional capacity may be secured by means of a check carried out by the Joint Undertaking or on its behalf by a competent official body of the country in which the service provider is established, subject to that body’s agreement. Such checks shall concern the supplier’s technical capacity and, if necessary, its study and research facilities and quality control measures.

Where the Joint Undertaking requires the production of certificates drawn up by independent bodies attesting the compliance of the economic operator with certain quality assurance standards, they shall refer to quality assurance systems based on the relevant European standards series certified by bodies conforming to the European standards series concerning certification.

An economic operator may, where appropriate and for a particular contract, rely on the capacities of other entities including subcontractors, regardless of the legal nature of the links which it has with them. It shall in that case prove to the Joint Undertaking that it will have at its disposal the resources necessary for performance of the contract, for example by producing an undertaking on the part of those entities to place those resources at its disposal.

Under the same conditions, a consortium may rely on the capacities of members of the consortium or of other entities including subcontractors. The reliance upon other entities including subcontractors shall be without prejudice to the question of the tenderers liability.
