The European Joint Undertaking for ITER and the Development of Fusion Energy (Fusion For Energy)

Engineering support in the fields of Radwaste treatment and storage, radiological and environmental monitoring system and nuclear safety. The framework contract will be implemented by specific task orders for self standing activities which will be placed during the course of the framework contract. The call for tender is divided into 3 lots, each lot representing a separate and distinct field and for which a separate framework contract will be awarded. A tenderer may submit a tender for one or more lots.

This contract notice has been published on the joint undertaking website more in particular on the industrial portal, the same date of its dispatch to the Supplement of the Official Journal of the European Communinities. Please note that only the contract notice published on the Joint undertaking's official Internet website (http://www.fusionforenergy.europa.eu/Procurement_operational.htm) is authentic. It should be noted that the present procurement procedure is governed by the rules laid down in the Financial Regulation of Fusion for Energy adopted by the Decision of the Governing Board of 22.10.2007 as last amended on 18.12.2007 and the Implementing Rules of the Financial Regulation adopted by the Decision of the Governing Board of 22.10.2007 as last amended on 8.7.2008. The participation in the present procurement procedure is open on equal terms to economic operators that are nationals of F4E members or are established in the territory of F4E members and to other economic operators from third countries. The official language of Fusion for Energy is English. Documentation provided under section III.2 shall be in English or accompained by a translation of the relevant parts. Failure to comply with this requirement, may lead to the exclusion of the candidate from the tender procedure.

Condiciones de participación
Habilitación para el ejercicio de la actividad profesional:

Tenderers shall be excluded from participation in the present procurement procedure if:

a) they are bankrupt or being wound up, are having their affairs administered by the courts, have entered into an arrangement with creditors, have suspended business activities, are the subject of proceedings concerning those matters, or are in any analogous situation arising from a similar procedure provided for in national legislation or regulations;

b) they have been convicted of an offence concerning their professional conduct by a judgement which has the force of res judicata;

c) they have been guilty of grave professional misconduct proven by any means which the Joint Undertaking can justify;

d) they have not fulfilled obligations relating to the payment of social security contributions or the payment of taxes in accordance with the legal provisions of the country in which they are established or with those of the country of the Joint Undertaking or those of the country where the contract is to be performed;

e) they have been the subject of a judgement which has the force of res judicata for fraud, corruption, involvement in a criminal organisation or any other illegal activity detrimental to the Joint Undertaking's or the Communities financial interests;

f) they are currently subject to an administrative penalty imposed by the Community institutions as referred to in the financial regulation applicable to the budget of the European communities.

Tenderers shall be excluded from the award of the contract if during the present procurement procedure:

g) they are subject to a conflict of interest;

h) they are guilty of misrepresentation in supplying the information required by the Joint Undertaking as a condition of participation in the contract procedure or fail to supply this information.

NB: In their tenders, tenderers shall provide a declaration on their honour, duly signed and dated, stating that they are not in one of the situations listed above, based on the specimen in annex 3. Only the tenderer to whom the contract is to be awarded shall provide the documents mentioned below before signature of the contract and within the deadline given by Fusion for Energy.

The following documents will be accepted as proof that the tenderer is not in any of the situations mentioned in points a), b), c),d), e), f):

i) for a), b) and e), the production of a recent extract from the judicial record or, failing that, an equivalent document recently issued by a judicial or administrative authority in the country of origin or provenance, showing that those requirements are satisfied;

ii) in the case mentioned in d), a recent certificate issued by the competent authority of the member state concerned.

Where the document or certificate referred to above is not issued in the country concerned it may be replaced by a sworn or, failing that, a solemn statement made by the interested party before a judicial or administrative authority, a notary or a qualified professional body in its country of origin or provenance;

iii) in the cases mentioned in c) and f), the tenderer will have to provide a sworn or, failing that, a solemn statement made by the interested party before a judicial or administrative authority, a notary or a qualified professional body in its country of origin or provenance.

Depending on the national legislation of the country in which the tenderer is established, the documents referred to above shall relate to legal persons and/or natural persons including company directors or any person with powers of representation, decision-making or control in relation to the tenderer.

Fusion for Energy may waive the obligation of the winning tenderer to submit this evidence if it has already been submitted to Fusion for Energy for the purposes of another procurement procedure and provided that the documents are not more than one year old starting from their issuing date and that they are still valid.

Situación económica y financiera:

The tenderer must have adequate financial and economic capacity for performing the scope of the contract in the indicated schedule. To this end, the following documents shall be provided by the tenderer in the offer:

a. The presentation of balance sheets and profit and loss account for the last 3 years for which accounts have been closed, where publication of the balance sheet is required under the company law of the country in which the economic operator is established.

b. The annual general turnover, relative to the specific lot services (as listed in sections 3.1 "scope" and 4.3 “division into lots, and detailed in annex B- technical specification) for the last 3 financial years.

Balance sheets and profit and loss account shall be presented in the template provided by Fusion for Energy in the annex 10 - simplified balance sheets and profit & loss account form.

Niveles mínimos de normas:

For the assessment of the economic and financial capacity, the following thresholds will be considered:

— The average annual general turnover of the tenderer (see point b. above) in the last 3 years must be greater than 1 000 000 EUR for lot 1, 1 000 000 EUR for lot 2 and 1 000 000 EUR for lot 3.

The threshold must be satisfied by the sum of the specific turnovers of the consortium members or subcontractors.

— A total (T) of 5 points resulting from the sum of viability standards sub-totals (ST) must be obtained, calculated according to the following formulas:

O ST1: liquid ratio = [(current assets) - (stocks)] / (current liabilities) x 100; if i <50 : 0 point; if 50 ≤ i ≤ 100 : 1 point; if i > 100 : 2 points.

O ST2: interest cover = EBIT / financial expenses; if i<2 : 0 point; if 2 ≤ i ≤ 3 : 1 point; if i >3 : 2 points.

O ST3: profit margin = (profit.loss before tax & extra.items) / (turnover) x 100; if i < 1 : 0 point; if 1 ≤ i ≤ 2 : 1 point; if i > 2: 2 points.

O ST4: gross margin = ((gross profit / turnover) x 100); if i < 4 : 0 point; if 4 ≤ i ≤ 8 : 1 point; if i > 8 : 2 points.

O ST5: Solvency = (Total Equity) / (Total Assets) x 100; i < 7 : 0 point; if 7 ≤ i ≤ 14: 1 point; if i > 14: 2 points.

Nota: “i” means “indicator”. Sub-totals are calculated by F4E with the template of annex 10.

If, for some exceptional reason which the Joint Undertaking considers justified, the tenderer is unable to provide the references requested above, its economic and financial capacity may be proved by any other means which the Joint Undertaking considers appropriate.

Capacidad técnica y profesional:

The tenderer must prove the full coverage of the professional competences and experience required to provide the services described in annex B, for each applied lot, by presenting evidence of:

a. 5 most relevant projects, executed within the last 3 years, covering all the categories of services listed in section 3.1 "scope", section 4.3 “division into lots” and more detailed in annex B.

It will be understood as relevant projects, activities implemented directly by the tenderers, members of the Consortium or subcontractors that could be classified under any of the categories of services listed in sections 3.1 "scope" and 4.3 “division into lots”.

b. The tenderer must prove the full coverage of the following professional competences:

— Lot 1: at least one Radwaste Management Senior Engineer (with more than 10 years specific professional experience in the field), 2 Radwaste Management junior engineer (with more than 5 years specific professional experience in the field) and one licensing engineer (with more than 5 years experience in nuclear licensing in the framework of French nuclear regulation).

— Lot 2: at least one radiological and environmental monitoring senior engineer (with more than 10 years specific professional experience in the field), 2 radiological and environmental monitoring junior engineer (with more than 5 years specific professional experience in the field) and one licensing engineer (with more than 5 years experience in nuclear licensing in the framework of French nuclear regulation).

— Lot 3: at least one licensing senior engineer (with more than 10 years experience in nuclear licensing, in the framework of French nuclear regulation) and 1 licensing junior engineer with more than 5 years experience in nuclear licensing in the framework of French nuclear regulation).
