— Span of 43m,

One (1) 120t cargo lift with principal features:
— 120t capacity lift,
— Size of object 3,7m high x 2,7m wide x 8,5m long,
— Nominal floor of lift internal 4,3m wide X 9,1m long,
— Height of lift 32m,
— Nuclear load, lift will subject to approval by Nuclear Regulator, require full documentation and be based upon ALARP/ALARA,
— Lift to be controlled from both the lift car and from a remote control room,
— The nuclear load will be contained but will not be shielded,
— Seismic qualification.
The scope of the design, certification, manufacturing, testing, installation and commissioning of the cranes and lifting beam will include rails and their mounting system, all control gear/transformers, power supplies from a fixed point in the building, maintenance hoists, platforms and the delivery of all supporting documentation.
The scope of the design, certification, manufacturing, testing, installation and commissioning of the tokamak cargo lift will include the carriage, carriage doors, hoisting mechanism, lift shaft mounted equipment, electrical control gear, local/remote controls and the delivery of all supporting documentation to meet the standards of the Nuclear Regulatory Authority.

This procurement procedure shall be open on equal terms to economic operators that are nationals of a member of Fusion for Energy or are established in the territory of a member of Fusion for Energy (i.e. member states of the European Union and Switzerland).

The following information and documents shall be provided in the request to participate:

a) Full name of the entity, legal status, company registration number, VAT registration number, registered address, telephone and fax numbers, the name of the contact person responsible for the request for participation as well as the name of the legal representative of the entity, as signatory of the contract (see Annex 04 “Company identification form” available at https://industryportal.f4e.europa.eu/default.aspx);

b) Commercial undertakings must provide a transcript or a certificate, issued by the competent body (namely the commercial register in the country of origin or the country of the main office of the candidate) or their act of incorporation as commercial undertaking, as well as a copy of their act of incorporation. Non-commercial undertakings may provide a copy of their act of incorporation if, under the law of their country of origin or the country of their main office, they are not subject to public registry. Non-commercial physical persons must provide a copy of their passport or other equivalent identification document.

Requirements under a) and b) shall be provided by each member of the grouping (if applicable).

c) Power of attorney duly completed and signed to demonstrate that the person signing is entitled to take a commitment on behalf of the company;

d) Declaration that in the event the entity is invited to tender, their tender will include a declaration that it understands that ITER has been designated by France as an “Installation nucléaire de base” (INB) and that French nuclear regulations will be applicable to part of the activities to be undertaken under the contract. The entity should therefore be able to demonstrate that the personnel responsible for those relevant activities are suitably qualified to work in accordance with these regulations.

In order to be able to participate in this procurement procedure, candidates must not find themselves in any of the exclusion situations referred to in Articles 83 and 84 of Fusion for Energy’s Financial Regulation adopted by the Decision of the Governing Board of 22.10.2007, as subsequently amended.

In particular candidates shall be excluded from participation in the present procurement procedure if:

a) they are bankrupt or being wound up, are having their affairs administered by the courts, have entered into an arrangement with creditors, have suspended business activities, are the subject of proceedings concerning those matters, or are in any analogous situation arising from a similar procedure provided for in national legislation or regulations;

b) they have been convicted of an offence concerning their professional conduct by a judgement which has the force of res judicata;

c) they have been guilty of grave professional misconduct proven by any means which Fusion for Energy can justify;

d) they have not fulfilled obligations relating to the payment of social security contributions or the payment of taxes in accordance with the legal provisions of the country in which they are established or with those of the country of Fusion for Energy or those of the country where the contract is to be performed;

e) they have been the subject of a judgement which has the force of res judicata for fraud, corruption, involvement in a criminal organisation or any other illegal activity detrimental to Fusion for Energy’s or to the Communities’ financial interests;

f) they are currently subject to an administrative penalty imposed by the Community institutions as referred to in the Financial Regulation applicable to the budget of the European communities;

g) they are subject to conflict of interest;

h) they are guilty of misrepresentation in supplying the information required by the contracting authority as a condition of participation in the contract procedure or fail to supply information.

For each of these points from (a) to (h), companies shall submit a declaration on honour duly signed and dated by its legal representative stating that they are not in any of such situation (see Annex 01 “Declaration on honour” available at https://industryportal.f4e.europa.eu).

In case of joint requests to participate the exclusion criteria will be assessed individually for each member of the grouping. Therefore, the declaration on honour, duly signed and dated, stating that the candidate is not in one of the above mentioned situation, must be provided by each of the members of the grouping. If a member of the grouping is subject to exclusion, the rest of the grouping shall be excluded.

The tenderer to whom the contract is to be awarded shall provide, within a time limit defined by Fusion for Energy and preceding the signature of the contract, the relevant documentary evidence, as detailed in the tender documentation.

The following documents will be accepted as proof that the tenderer is not in any of the situations mentioned in points a), b), c),d), e), f):

i. for a), b) and c), the production of a recent extract from the judicial record or, failing that, an equivalent document recently issued by a judicial or administrative authority in the country of origin or provenance, showing that those requirements are satisfied;

ii. in the case mentioned in d), a recent certificate issued by the competent authority of the Member State concerned.

Where the document or certificate referred to above is not issued in the country concerned it may be replaced by a sworn or, failing that, a solemn statement made by the interested party before a judicial or administrative authority, a notary or a qualified professional body in its country of origin or provenance.

iii. in the cases mentioned in e) and f), the tenderer will have to provide a sworn or, failing that, a solemn statement made by the interested party before a judicial or administrative authority, a notary or a qualified professional body in its country of origin or provenance.

Depending on the national legislation of the country in which the tenderer is established, the documents referred to above shall relate to legal persons and/or natural persons including company directors or any person with powers of representation, decision-making or control in relation to the tenderer.

Fusion for Energy may waive the obligation of the winning tenderer to submit this evidence if it has already been submitted to Fusion for Energy for the purposes of another procurement procedure and provided that the documents are not more than one year old starting from their issuing date and that they are still valid.

Situación económica y financiera:

The candidate must have adequate financial and economic capacity to perform the contract within the indicated timeframe. To this end, the following documents shall be provided by the candidate and, in case of a joint request to participate, by each member of the grouping:

a) A statement on the good financial standing of the candidate from a bank;

b) Evidence of relevant professional risk indemnity insurance under French law for economic operators established in France or equivalent for economic operators established outside France;

c) The presentation of balance sheets and profit and loss account for the last three years for which accounts have been closed, where publication of the balance sheet is required under the company law of the country in which the economic operator is established. Balance sheets and profit and loss account shall be presented both in their official format and in the template provided by Fusion for Energy (see Annex 02 “Economic financial capacity” available at https://industryportal.f4e.europa.eu/default.aspx).

For the assessment of the economic and financial capacity, the following ratios/noteworthy values and threshold will be considered (for these calculations the average of each parameter over the last three financial years according to information provided in Annex 02 will be considered):

A. Minimum viability standards.

For these calculations the average total points “T”, representing the sum of average subtotals (from ST1 to ST5) over the last three financial years according to information provided in Annex 02, will be considered.

ST1: liquid ratio = [(current assets) - (stocks)] / (current liabilities) x 100; if i <50: 0 points; if 50 ≤ i ≤ 100 : 1 point; if i > 100: 2 points.

ST2: interest cover = EBIT / financial expenses; if i < 2: 0 points; if 2 ≤ i ≤ 4: 1 point; if i > 4: 2 points.

ST3: profit margin = (profit.Loss before tax & extra.items) / (turnover) x 100; if i < 2: 0 points; if 2 ≤ i ≤ 4: 1 point; if i > 4: 2 points.

ST4: gross margin = (gross profit) / (turnover) x 100; if i < 4: 0 points; if 4 ≤ i ≤ 8: 1 point; if i > 8: 2 points.

ST5: solvency = (total equity) / (total assets) x 100; i < 12: 0 points; if 12 ≤ i ≤ 26: 1 point; if i > 26: 2 points.

Nota: “i” means “indicator”.

B. Noteworthy values/ratios to be achieved.

Turnover.

— Noteworthy value: average overall turnover over the past three years,

— Evaluation: negative if noteworthy value < 50 000 000 EUR.

Simplified cash flow = (net profit) + (depreciation) - (extra. revenues) + (extra. expenses).

— Noteworthy value: average cash flow over the past three years,

— Evaluation: negative if ratio < 5 000 000 EUR.

In relation with both A and B:

The economic and financial capacity will be considered adequate for performance of the contract if the total of points granted T (sum of subtotals) is ≥ 5.

And:

At least one of the two noteworthy values/ratios (turnover, cash flow) is considered positive.

i. With regard to joint requests to participate (groupings) the noteworthy values/ratio will be assessed globally (all members of the grouping together);

ii. If, for some exceptional reason which Fusion for Energy considers justified, the candidate is unable to provide the references requested above, its economic and financial capacity may be proven by any other means which Fusion for Energy considers appropriate;

iii. An economic operator may, where appropriate, rely on the financial capacities of other entities including subcontractors, regardless of the legal nature of the links which it has with them in order to fulfil the above criteria. In such a case, the above mentioned other entities will be evaluated as they were member of a consortium. The economic operator must in that case prove to Fusion For Energy that it will have at its disposal the resources necessary for performance of the contract, for example by producing an undertaking on the part of those entities to place those resources at its disposal. Templates for this purpose are provided in Annexes 05 and 06 and are available at https://industryportal.f4e.europa.eu.

Capacidad técnica y profesional:

The candidate shall provide the following in the request to participate:

a) A list of contracts over the last 10 years executed by the candidate for the design, certification, manufacturing, testing, installation and commissioning of items similar to those described under section II.1.5. The list shall contain at least:

i. three (3) separate contracts, each for at least one (1) non nuclear Electric Overhead Travelling (EOT) crane with over 250 tonnes lifting capacity and;

ii. one (1) contract for a remotely controlled lift for a nuclear load.

The request to participate shall include a brief description of the subject matter of the contracts, information on the supplies/services provided and their corresponding values. For each of the contracts a document issued by the customer certifying satisfactory execution of the contract shall also be included.

The required contracts under i) and ii) above may also be a contribution of a member of a group as part of a more extensive contract covering additional supplies, works and/or services, or it may be a subcontract.

A summary of the above shall be given by the candidate, please refer to Annex 03 available at https://industryportal.f4e.europa.eu/default.aspx for the format to be filled in.

b) A brochure presenting the company;

c) As a minimum, copies of the ISO9001 and ISO14001 certificates (or equivalent). In addition a list of any other relevant professional and quality certificate;

d) A document presenting:

i. the candidate’s general health and safety and environmental information including the company’s policy, management procedures and statistical records for the last 5 years demonstrating candidate’s records are better than the EU reference level, and;

ii. the candidate’s health and safety records for each of the contracts listed under a) above, including working hours, number of accidents and number of lost working days per month for the main contract and subcontractors;

e) A document describing the company’s previous experience in design, manufacturing, installation and commissioning of seismically qualified cranes and specialist lifting equipment in the nuclear industry and detailing similar contracts awarded, including the values of said contracts, the owner’s name. Copies of certificates demonstrating nuclear regulatory approval shall also be provided;

f) A declaration of the candidate confirming the availability of adequate design, manufacturing and site installation capacity for carrying out the contract;

g) A description of the QA procedures and processes used by the candidate for ensuring quality through design, nuclear regulatory acceptance, procurement, manufacture, factory acceptance tests, installation and commissioning;

h) Organisational chart of the group of companies (parents, subsidiaries and affiliate companies) to which the candidate belongs;

i) Declaration of any related ITER work performed in the last 5 years by any of the companies pertaining to the same group (parents, subsidiaries and affiliate companies).

An economic operator may, where appropriate, rely on the capacities of other entities including subcontractors, regardless of the legal nature of the links which it has with them. It must in that case prove to Fusion for Energy that it will have at its disposal the resources necessary for performance of the contract, for example by producing an undertaking on the part of those entities to place those resources at its disposal. Templates for this purpose are provided in Annexes 05 and 06 (available at https://industryportal.f4e.europa.eu).

The minimum value of each contract under point (a.i) above shall not be less than 5 000 000 EUR (five million EUR) and the minimum value of the contract under point (a.ii) above shall not be less than 500 000 EUR (five hundred thousand EUR).

In case of a grouping, the above values can be for the contribution of an individual member of a group or for the aggregate value of contributions if these members are part of the grouping for the current call for expression of interest.

Advance payment guarantees and performance guarantees as stated in the contract documents, shall apply.

Requests to participate may be submitted by groupings of economic operators who will not be required to adopt a particular legal form prior to the contract being awarded provided that each member of the grouping is jointly and severally liable towards Fusion for Energy.

However, a grouping of companies must nominate a coordinator to be responsible for the receipt and processing of payments for members of the grouping, for administrative management of the service and for coordination and safety.

A company cannot be coordinator of several groupings for this procedure, nor can it simultaneously submit its candidacy as coordinator of a grouping and individually.

Groupings of companies must provide the documents and information required in points III.2.1, III.2.2 (a), (b), (c) and III.2.3 (b), (c), (d.i), (g) for each member of the grouping.

The documents and information required in points III.2.3 (a), (d.ii), (e) and (f) apply to the grouping as a whole.

F4E will first exclude the candidates which are non-compliant with administrative, legal or financial requirements (see section III.2.1) and which cannot demonstrate adequate financial, economic or technical capacity levels (see sections III.2.2 and III.2.3).

F4E shall then select candidates according to the following technical and professional capacity criteria (up to 100 points maximum):

a) The candidate’s health and safety performance demonstrated through the general health and safety statistical record of the company(ies) over the last 5 years (see point III.2.3)d)i). Points will be awarded for low incidence, low frequency and low severity rates measured against EU indicators, stating working hours, number of accidents, number of lost working days per month, including subcontractors (maximum 10 points to be awarded);

b) The candidate’s health and safety performance demonstrated through the health and safety statistical record of the company(ies) (see point III.2.3)d)ii) on the contracts referred to under point III.2.3)a). Points will be awarded for low incidence, low frequency and low severity rates measured against EU indicators, stating working hours, number of accidents, number of lost working days per month, including subcontractors (maximum 10 points to be awarded);

c) Relevance of the candidate’s experience demonstrated through the list provided for contracts concerning the design, certification, manufacture, test, installation and commissioning of non nuclear EOT cranes above 250 tonnes lifting capacity, executed during the last 10 years (see point III.2.3)a)i). Points will also be awarded on the aggregate value of contracts (maximum 30 points to be awarded);

d) Relevance of the candidate’s experience demonstrated through the list provided for contracts concerning the design, certification, manufacture, test, installation and commissioning of seismically qualified cranes and specialist lifting equipment on nuclear licensed sites executed during the last 10 years (see point III.2.3)e) (maximum 20 points to be awarded);

e) Relevance of the candidate’s experience demonstrated through the list provided for contracts concerning the design, certification, manufacture, test, installation and commissioning of (a) remotely controlled cargo lift(s) for a nuclear load executed during the last 10 years, together with certificates demonstrating nuclear regulatory approval (see point III.2.3)a)ii). Points will also be awarded on the (aggregate) value of (the) contract(s) (maximum 30 points to be awarded).

The envelope, containing 3 paper copies and one electronic copy of the documentation referred to in Section III.2 shall be addressed to the procurement officer indicated under Section I.1 and shall be marked as follows: “Expression of interest F4E-OPE-285 (SB.PS) Not to be opened by the internal mail services”.

The deadline for submission of expression of interest is indicated in section IV.3.4) of this contract notice.

This contract notice has been published on the Fusion for Energy Industry Portal website. Please note that only the contract notice published on the Fusion for Energy industry portal website (https://industryportal.f4e.europa.eu) is authentic.

Economic operators shall be aware that any further communication related to the present Call for Expression of Interest and notification of corrigenda (if any) will only be published on the Fusion for Energy Industry Portal website, as mentioned above. It is therefore strongly suggested to regularly visit the above mentioned webpage. By submitting a Request to Participate the economic operator agrees that Fusion for Energy may publish on its website a list with the names and addresses of the selected candidates. In case an economic operator does not agree with this, he shall express this disagreement in writing to the above mentioned contact point (Section I.1), before the time limit for receipt of the requests to participate.

Applicable rules.

It should be noted that the present procurement procedure is governed by the rules laid down in the Financial regulation of fusion for energy adopted by the decision of the governing board of 22.10.2007 as last amended on 18.12.2007 and the Implementing rules of the financial regulation adopted by the decision of the governing board of 22.10.2007 as last amended on 8.7.2008.

The official language of Fusion for Energy is English. Documentation provided shall be in English or accompanied by a translation of the relevant parts. Failure to comply with this requirement, may lead to the exclusion of the candidate from the tender procedure.

Fusion for Energy may, before the contract is signed, either abandon or cancel the award procedure or part thereof without the candidates being entitled to claim any compensation.
