The European Joint Undertaking for ITER and the Development of Fusion Energy ("Fusion for Energy")

Framework Supply Contract with a single economic operator for the provision of Software Acquisition Channel for Fusion for Energy. The Contract will be concluded for a period of 24 months, renewable once for a period of 24 months, with a total maximum duration of 48 months (4 years).

Condiciones de participación
Habilitación para el ejercicio de la actividad profesional:

Tenderers shall provide a declaration on their honour, duly signed and dated, stating that they are not in any of the situations listed below,failing which they shall be excluded from participation:

a) They are bankrupt or being wound up, are having their affairs administered by the courts, have entered into an arrangement with creditors, have suspended business activities, are the subject of proceedings concerning those matters, and are in any analogous situation arising from a similar procedure provided for in national legislation or regulations;

b) They have been convicted of an offence concerning professional conduct by a judgment which has the force of res judicata;

c) They have been guilty of grave professional misconduct proven by any means which the contracting authority can justify;

d) They have not fulfilled all obligations relating to the payment of social security contributions and the payment of taxes in accordance with the legal provisions of the country in which they are established, with those of the country of the contracting authority and those of the country where the contract is to be carried out;

e) They have been the subject of a judgement which has the force of res judicata for fraud, corruption,involvement in a criminal organisation or any other illegal activity detrimental to the Union's financial interests;

f) They are currently subject to an administrative penalty for being guilty of misrepresentation in supplying the information required by the contracting authority as a condition of participation in the procurement procedure or failing to supply an information, or being declared to be in serious breach of his obligation under contract covered by the budget.

Please also consult the integral text of the declaration on honour annexed to the Tender Specifications. The Tenderer to whom the contract is awarded shall be requested to provide, within a time limit defined by Fusion for Energy and preceding the signature of the contract, the documentary evidence stipulated in the Tender Specifications confirming the declaration on honour.

The Tenderer must provide evidence of enrolment (declaration or certificates) in the professional or commercial/trade registration imposed by the country in which the Tenderer is established; specifically for practicing activities relevant to the scope of this Tender.

Situación económica y financiera:

The Tenderer must prove its financial and economic capacity to implement the Contract resulting from this tendering procedure by submitting one or more of the following documents:

— annual accounts, balance sheets or extracts (where publication of the balance sheet is required under company law in the country of establishment) for the previous three financial years;

— statement of the Tenderer's overall turnover for the previous three financial years.

The Tenderer is required to demonstrate using the above-mentioned documents that they have a minimum annual turnover corresponding to at least 3.000.000 EUR.

If, for any valid reason, the Tenderer is unable to provide the references requested by the Contracting authority, he may prove his economic and financial standing by any other document which the Contracting authority considers appropriate.

In the event of a consortium submitting an offer or in the case of subcontracting, balance sheets (for the previous three financial years) of all proposed subcontractors or all individual consortium members should be included in the offer.

Consequently, the Tenderer, or the consortium of service providers, or the Tenderer together with the proposed subcontractors will demonstrate a minimum annual turnover corresponding to at least 3.000.000 EUR.

Capacidad técnica y profesional:

The Tenderer must prove the full coverage of the professional competences and experience at a level commensurate with the duties described in the Tender Specifications.

Evidence of the technical capacity must be provided by presenting documentation as to the following criteria:

1. Tenderers organization and staffing structure and availability:

1.1 Criteria - Minimum requirements:

To have sufficient staff to provide and fulfil the services requested by F4E: at least an account manager for contract management and another person in charge of licence acquisition and software lifecycle management activities

Evidence:

Document describing the organizational structure proposed

1.2 Criteria - Minimum requirements:

To ensure service continuity throughout the year: an alternate for the staff in charge of license and service acquisition must be always in place

Document detailing failover possibilities in case staff is absent, for both licence acquisition, software lifecycle management and services

2. Service capacity and quality of resources:

2.1 Criteria - Minimum requirements

Ability to supply and take over the maintenance of all the ISVs included in Annex X (F4E Software Catalogue)

Declaration on Honour confirming that the Tenderer will be able to supply and take over maintenance for those ISVs (Annex X)

3. Improvement of licensing conditions:

3.1 Criteria - Minimum requirements:

Capacity to continuously improve licensing conditions for its customers: at least 2 examples (from previous contracts)

A proven track record of activities carried out (in the past) by the Contractor to continuously improve licensing conditions for its customers (examples: proposals to enter into volume licensing agreements where applicable, negotiations with ISVs on behalf of the customer…).

4. Experience providing service:

4.1 Criteria - Minimum requirements:

Demonstrate enough experience managing and providing similar contracts/services: at least 2 references to similar service contracts concluded in the last 5 years

List of similar service Contracts concluded in the last 5 years, including the following information for each one:

— Total budget (software acquisition services only);

— Duration and dates (mm/yy).

The opening of received tenders will take place at Fusion for Energy's premises, Josep Pla, nr 2, Torres Diagonal Litoral, Building B3, Barcelona, Spain. Tenderers who have submitted an offer will be allowed to participate in the public opening. The location of the meeting room for the opening session will be communicated on the day of the opening at the reception desk of the building. The tenderer should be duly represented and should be able to prove that they represent the tenderer. Maximum one representative per tenderer may attend the opening session and their participation will be restricted to an observer role.
