The European Joint Undertaking for ITER and the Development of Fusion Energy ("Fusion for Energy")

The scope of the Multiple Framework Contracts comprises the design, manufacturing, delivery, on-site integration, commissioning, and final acceptance tests of components and systems to be delivered in-kind to ITER.
ITER is an international project to design and build an experimental fusion reactor based on the tokamak concept. General information on the project is available at www.iter.org.
The components and systems subject of this call are intended for maintenance and replacement of equipment located in the nuclear fusion reactor. They are identified in the ITER project breakdown structure (PBS) as:
PBS 23.02: Divertor Remote Handling System.
PBS 23.03: Cask and Plug Remote Handling System.
PBS 23.05: Neutral Beam Cell Remote Handling System.
Multiple Framework Contracts in cascade will be placed for each of the following lots:
Lot 1 - Divertor Remote Handling System (DIV RHS) and related activities;
Lot 2 - Cask and Plug Remote Handling System (CPRHS), also known as Transfer Cask System (TCS), and related activities;
Lot 3 - Neutral Beam Cell Remote Handling System (NBRHS) and related activities.
Further information about the three Lots is provided in Annex B.
An additional Remote Handling System, identified in the ITER project breakdown structure (PBS) as PBS 23.04: In-Vessel Viewing System, is explicitly excluded from this Call. Such system will be subject to a separate Call for Expression of Interest in the near future.

The Divertor RH System provides the means for the remote replacement of the ITER Divertor System. The Divertor RHS concept relies on the use of heavy RH transporters (known as “Cassette Movers”) and dexterous tele-manipulators. The Divertor RHS makes use of the ITER Cask and Plug RH System (PBS 23.03, see description of Lot No. 2) to house the remote handling equipment, to transport contaminated / radioactive in-vessel components away from the tokamak building, and to bring replacement parts to the vacuum vessel inlet ports.

ITER is a joint international research and development project that aims to demonstrate the scientific and technical feasibility of fusion power. The partners in the project - the ITER Parties - are the European Union (represented by EURATOM), Japan, the People´s Republic of China, India, the Republic of Korea, the Russian Federation and the USA.

ITER will be constructed in Europe, at Cadarache in the South of France.

III.2.1.1) Exclusion criteria

Exclusion criteria are listed in Articles 83 and 84 of Fusion for Energy’s Financial Regulation, available at: http://f4e.europa.eu/procurementsgrants/keyreference.aspx.

Applicants shall be excluded from participation in the present procurement procedure if:

a) they are bankrupt or being wound up, are having their affairs administered by the courts, have entered into an arrangement with creditors, have suspended business activities, are the subject of proceedings concerning those matters, or are in any analogous situation arising from a similar procedure provided for in national legislation or regulations;

b) they have been convicted of an offence concerning their professional conduct by a judgement which has the force of res judicata;

c) they have been guilty of grave professional misconduct proven by any means which Fusion for Energy can justify;

d) they have not fulfilled obligations relating to the payment of social security contributions or the payment of taxes in accordance with the legal provisions of the country in which they are established or with those of the country of Fusion for Energy or those of the country where the contract is to be performed;

e) they have been the subject of a judgement which has the force of res judicata for fraud, corruption, involvement in a criminal organisation or any other illegal activity detrimental to Fusion for Energy’s or to the European Union financial interests;

f) they are currently subject to an administrative penalty imposed by the European Union institutions as referred to in the Financial Regulation applicable to the budget of the European Union;

g) they are subject to conflict of interest;

h) they are guilty of misrepresentation in supplying the information required by the contracting authority as a condition of participation in the contract procedure or fail to supply information.

Participants shall provide a declaration on their honour (see Annex 01 "Declaration on Honour" available at https://industryportal.f4e.europa.eu/default.aspx), duly signed and dated, stating that they are not in one of the situations listed above.

In case of Joint Requests to Participate (joint partners or subcontracting), exclusion criteria will be assessed in relation to each individual economic operator. Therefore, the declaration on honour, duly signed and dated, must be provided by each individual economic operator.

Only the participant to whom the contract is to be awarded shall provide the documents mentioned below before signature of the contract and within the deadline given by Fusion for Energy.

The following documents will be accepted as proof that the participant is not in any of the situations mentioned in points a), b), c),d), e), f):

i. for a), b) and c), the production of a recent extract from the judicial record or, failing that, an equivalent document recently issued by a judicial or administrative authority in the country of origin or provenance, showing that those requirements are satisfied;

ii. in the case mentioned in d), a recent certificate issued by the competent authority of the Member State concerned. Where the document or certificate referred to above is not issued in the country concerned it may be replaced by a sworn or, failing that, a solemn statement made by the interested party before a judicial or administrative authority, a notary or a qualified professional body in its country of origin or provenance.

iii. in the cases mentioned in e) and f), the participant will have to provide a sworn or, failing that, a solemn statement made by the interested party before a judicial or administrative authority, a notary or a qualified professional body in its country of origin or provenance.

Depending on the national legislation of the country in which the tenderer is established, the documents referred to above shall relate to legal persons and/or natural persons including company directors or any person with powers of representation, decision-making or control in relation to the tenderer.

Fusion for Energy may waive the obligation of the winning participant to submit this evidence if it has already been submitted to Fusion for Energy for the purposes of another procurement procedure and provided that the documents are not more than one year old starting from their issuing date and that they are still valid.

III.2.1.2) Nationality

This procurement procedure is open on equal terms to economic operators that are nationals of a member of Fusion for Energy or are established in the territory of a member of Fusion for Energy (i.e. Member States of the European Union and Switzerland).

As evidence that the participant is authorised to perform the contract under national law, the participant shall provide the following information and documents in the request to participate:

a) Full name of the entity, legal status, company registration number, VAT registration number, registered address, telephone and fax numbers, the name of the contact person responsible for the request for participation as well as the name of the legal representative of the entity, as signatory of the contract (see Annex 03 “Company Identification Form” available at https://industryportal.f4e.europa.eu/default.aspx).

For commercial undertakings, the information provided under a) shall be accompanied by a transcript or a certificate, issued by the competent body (namely the commercial register in the country of origin or the country of the main office of the participant).

Non-commercial undertakings may provide a copy of their act of incorporation if, under the law of their country of origin or the country of their main office, they are not subject to public registry.

Non-commercial physical persons must provide a copy of their passport or other equivalent identification document.

In case of Joint Requests to Participate (joint partners or subcontracting), this selection criterion will be assessed in relation to each individual economic operator. Therefore, requested documentation under a), must be provided by each individual economic operator.

Situación económica y financiera:

The participant must have adequate financial and economic capacity to perform the contract. To provide evidence of this, the following documents shall be provided:

1a) a statement of the overall annual turnover for the last three (3) financial years;

2a) presentation of balance sheets or extracts from balance sheets for at least three (3) years for which the accounts have been closed (see Annex 02 "Simplified Balance Sheet and Profit & Loss Acount Form" available at https://industryportal.f4e.europa.eu/default.aspx), where publication of the balance sheet is required under the company law of the country in which the economic operator is established.

For the assessment of the economic and financial capacity, the thresholds under 1b) and 2b) below shall be achieved.

An economic operator may, where appropriate, rely on the economic and financial capacities of other entities, including subcontractors, regardless of the legal nature of the links which it has with them. lt must in that case prove to the Joint Undertaking that it will have at its disposal the resources necessary for performance of the contract, by submitting a duly signed Undertaking Form (see Annex 04 "Undertaking Form" available at https://industryportal.f4e.europa.eu/default.aspx) on the part of that entity to place those resources at its disposal.

1b) Overall annual turnover.

The average annual turnover for the last three (3) financial years must be above the following values:

— Lot 1, Divertor RH System: 25 000 000 EUR,

— Lot 2, Cask and Plug RH System: 70 000 000 EUR,

— Lot 3, Neutral Beam Cell RH System: 25 000 000 EUR.

In case an economic operator submits a request to participate for more than one Lot, the applicable turnover threshold will be the sum of the thresholds of the relevant Lots.

In case of joint requests to participate, this selection criterion will be assessed in relation to the participating group as a whole, including joint partners and/or subcontractors that have submitted an Undertaking Form.

2b. Financial Viability

The following ratios and thresholds will be considered:

2b-1. Solvency ratio (Total Equity / Total Assets x 100). The evaluation will be considered negative if ratio < 0.

2b-2. Liquidity ratio ((Current Assets – Inventories) / Current Liabilities x 100). The evaluation will be considered negative if ratio < 50.

In case of joint requests to participate (joint partners and/or subcontractors that have submitted an Undertaking Form), this selection criterion will be assessed in relation to each economic operator.

If, for some exceptional reason which the Joint Undertaking considers justified, the applicant is unable to provide the references requested above, its economic and financial capacity may be proved by any other means which the Joint Undertaking considers appropriate.

Capacidad técnica y profesional:

0) The following RH-related technologies and activities are considered relevant for the selection of the candidates that will be invited to participate in the dialogue:

T1: engineering services (design, manufacturing follow-up, integration follow-up, commissioning/qualification);

T2: nuclear grade design (capacity to design with adapted behaviour under failure, to implement and qualify rad-hard technologies, to perform safety hazard analysis and implement mitigation design actions to reduce risk, to perform integrated dose calculations from radiation mapping, to implement ALARA approach and nuclear waste class identification studies...).

T3: development and supply of precision moving machinery.

T4: development and supply of tele-operated robotic arms.

T5: development and supply of remote control systems.

T6: manufacturing, machining, tooling and welding of mechanical parts.

T7: assembly, integration and test of machines and mechanical parts.

As evidence of his technical and professional capacity, the participant is requested to provide:

1a) A list of seven (7) contracts with relevance to any of the RH-related technologies and activities defined under bullet 0) above.

2a) For each Lot the participant is applying for, a list of three (3) contracts, concluded during the last five (5) years, covering one or more of the following specific Remote Handling technologies and activities (among those defined under bullet 0 above):

— application for Lot 1: T1 + T2 + T3 + T4 + T5,

— application for Lot 2: T1 + T2 + T3 + T5 + T7,

— application for Lot 3: T1 + T2 + T3 + T4 + T5.

The 3 contracts mentioned under this bullet 2a) may be in addition to or be part of the submitted list of contracts under bullet 1a) above. For application for multiple Lots, individual lists shall be provided. The same contract can be present in more than one list.

3a) For each Lot the participant is applying for:

3a-1. An overview of the educational and professional qualifications (CV’s) of five (5) Senior Engineers who are skilled and have experience in any of the Remote Handling relevant technologies and activities mentioned under bullet 0) above;

3a-2. An overview of the educational and professional qualifications (CV’s) of three (3) Senior Project Managers who are skilled and have managed at least five (5) projects in any of the Remote Handling technologies and activities relevant for a given Lot, as listed under bullet 2a) above.

A table showing how the different RH-related skills are covered by the proposed personnel shall be provided. Nuclear design related activities (T2) shall be detailed.

4a) The "Supplier QA Questionnaire", Annex 06 to this Call for Expression of Interest, downloadable at https://industryportal.f4e.europa.eu/default.aspx, duly filled and signed, and accompanied by the requested support documentation.

N.B.: For all the contracts/projects included in the lists mentioned at bullets 1a, 2a and 3a-2 above, the following information shall be provided as a minimum: a brief description of the subject matter of the contract, the signature date, the contract value and duration, contract customers/end users (specifying if either public or private), the main actors (components of the industrial group) and the precise responsibilities of the participant, the list of which of the RH relevant technologies and activities specified under bullet 0) above are covered, the performed engineering services, and the nuclear design related tasks.

1b) For the contracts under bullet 1a) in the left column, the following requirements will apply:

1b-1. all of the seven (7) contracts need to have been signed during the last ten (10) years, with at least three (3) contracts having been concluded during the last five (5) years. The participant is requested to list the projects in order of preference as only the first five (5) contracts will be considered for selection (see section IV.1.2). The additional two projects will only be taken into account in case one or two of the first five contracts should not be considered as relevant.

1b-2. listed contracts should each have a minimum duration of three (3) years and should each have the following minimum value (for the RH part):

— application for Lot 1 or Lot 3 only: 5 000 000 EUR,

— application for Lot 2 only or any combination of multiple Lots: 10 000 000 EUR.

2b) For the contracts under bullet 2a) in the left column, the three contracts together shall cover (as a whole) the subset of RH technologies relevant to the specific Lot, as defined under same bullet 2a).

3b) The CVs under bullet 3a) in the left column will be considered acceptable if:

3b-1. The average experience of the five senior engineers in the area of remote handling is at least ten (10) years, and the areas of expertise of the five engineers (considered all together) covers all of the Remote Handling relevant technologies and activities mentioned under bullet 2a);

3b-2. The average experience of the three senior project managers in the area of project management is at least ten (10) years, and the previous project management experience of the three senior project managers (considered all together) covers all of the Remote Handling relevant technologies and activities mentioned under bullet 2a).

4b) The score achieved in the "Supplier QA Questionnaire" requested under bullet 4a) is higher than 25, and all required documentation is provided and acceptable.

An economic operator may, where appropriate, rely on the technical and professional capacities and capabilities of other entities, including subcontractors, regardless of the legal nature of the links which it has with them. It must in that case prove to the Joint Undertaking that it will have at its disposal the resources necessary for performance of the contract, by submitting the Undertaking Form on the part of that entity stating their unambiguous undertaking to collaborate with the tenderer and to place those resources and capabilities at its disposal.

In case of joint requests to participate, the selection criteria under bullets 1b), 2b) and 3b) will be assessed in relation to the participating group as a whole, including joint partners and/or subcontractors that have submitted an Undertaking Form; criterion 4b) will be assessed in relation to each economic operator having submitted the Undertaking Form.

Depósitos y garantías exigidos:

Fusion for Energy reserves the right to require from the contractor to provide Advance Payment Guarantees and/or Performance Guarantees in accordance with the provisions of its financial regulations.

Requests to participate can be submitted by groupings of economic operators who will not be required to adopt a particular legal form prior to the contract being awarded. ln case the grouping has not yet adopted any legal form, participants shall be aware of the fact that if they are awarded the contract, Fusion for Energy will require them to sign a "power of attorney'' based on the Fusion for Energy model (see Annex 05 “Model Power of Attorney” available at https://industryportal.f4e.europa.eu/default.aspx) which provides for a form of cooperation.

The foreseen contract duration is 4 years plus 3 possible renewals, 1 year each. The maximum duration of the Multiple Framework Contract is set to be seven years in order to fit in with the ITER Project Schedule. The implementation of the Multiple Framework Contract foresees a staged technological trajectory that requires steady effort to move from preliminary design, and research and development to prototyping and testing, and to final design and manufacturing, along a time scale longer than four years.

Criterios objetivos para la selección:

Selection of candidates and invitation to participate to the dialogue will be conducted individually for each Lot. The dialogue phase and the following tendering phase will also be conducted separately for each Lot. F4E shall select candidates according to the technical and professional capacity criteria CR-1 and CR-2 below. The ranking of participants will be established by the sum of the points obtained according to criteria CR-1 and CR-2, up to a maximum of 100 points.

CR1. Five (5) contracts with relevance to the Remote Handling relevant technologies and activities as defined in bullet 0) of section III.2.3 above and compliant to the requirements defined in bullets 1b-1 and 1b-2 of the same section will be considered. Points (up to maximum 50 points) will be awarded based on the sum of the values of the 5 individual contracts, according to the following formula: [Awarded Points = 50 x (Total value / Total value MAX)], where "Total Value" is the sum of the values of the 5 individual submitted contracts by the economic operator, and "Total Value MAX" is the highest total value (for all economic operators that have met all exclusion and selection criteria).

CR2. Three (3) contracts with relevance to technologies and activities specific for each Lot as defined in bullet 2a of section III.2.3 above and compliant to the requirements defined in bullet 2b of the same section will be considered. Points (up to maximum 50 points) will be awarded based on the number of specific Remote Handling technologies and activities covered by the 3 contracts together, according to the following formula: [Awarded Points = 50 x (Specific scope / 15)], where "Specific scope" is the total sum of the Lot-relevant technologies covered by each of the three contracts,i.e. [Specific scope = N1+N2+N3], where, for each of contracts 1, 2 and 3, N is the number of technologies and activities relevant for a given Lot as specified under bullet 2a in section III.2.3. The maximum value for "Specific scope" is 15.

2. It should be noted that the present procurement procedure is governed by the rules laid down in the Financial Regulation of Fusion for Energy adopted by the Decision of the Governing Board of 22 October 2007 and its subsequent amendments and the Implementing Rules of the Financial Regulation adopted by the Decision of the Governing Board of 22 October 2007 and its subsequent amendments.

3. The envelope, containing 3 paper copies and 1 electronic copy of the requested documentation shall be addressed to the Procurement Officer indicated under section I.1) and shall be marked as follows:

"Expression of Interest F4E-OMF-340 - Not to be opened by the internal mail department".

The deadline for receipt of expression of interest is indicated in section IV.3.4. The compliance with the mandatory time limit (deadline) will be evaluated on the basis of the terms defined under Art. 118 of Fusion for Energy Implementing Rules.

4. This contract notice has been published on the Fusion for Energy Industry & Associations Portal. Please note that only the contract notice published on the Fusion for Energy Industry & Associations Portal is authentic. Economic operators shall be aware that any further communication related to the present tender procedure will only be published on the Fusion for Energy Industry & Associations Portal. It is therefore strongly suggested to regularly visit the above mentioned webpage.

5. The official language of Fusion for Energy is English. Documentation provided shall either be in English or accompanied by a translation of the relevant parts. Documents in languages other than English which are not accompanied by an English translation will not be considered for the evaluation. An official, certified translation in English shall be provided. In cases of urgency the Joint Undertaking may decide to accept a non certified provisional translation as an interim measure, but a certified translation shall always be eventually provided.

6. Fusion for Energy may, before the contract is signed, either abandon or cancel the award procedure or part thereof without the candidates being entitled to claim any compensation.
